Gachaguas Lawyers will do anything possible to salvage the Impeached DP carrier.

Impeached Deputy President Rigathi Gachagua’s lawyer, Ndegwa Njiru, was put in a challenging position during court proceedings on Thursday, October 24. At one point, Ndegwa was required to read the paragraphs he intended to remove from his application. His reluctance to read those paragraphs aloud prompted insistence from lawyers, judges, and attendees.

“Let me get it right, you mean the judge is closely associated with the wife?” Justice Mrima inquired. “No, I didn’t say that,” Ndegwa quickly retracted his statement, causing the entire courtroom to erupt in laughter. Ndegwa clarified his argument by asserting that Justice Ogola has close ties to President William Ruto, thereby questioning the court’s fairness.

He further claimed that Ruto assisted Ogola’s wife in obtaining a position at the Kenya Water Towers Agency through former Environment CS Soipan Tuya. “How can an impartial observer be assured that this court will administer substantive justice?” How can it be asserted that this court is impartial? The issue of a spouse’s connection to a judge, as outlined in Rule 47, is of utmost significance and must not be overlooked. “Why didn’t the court disclose this to us?” Ndegwa argued.

Ndegwa Njiru contended in court that the three-judge bench was formed for a specific purpose and is part of a conspiracy. Additionally, he notified the court of his intention to withdraw paragraphs 10 and 16 of his application. This raised questions, with Justice Ogola insisting on understanding why the paragraphs should be removed. Ogola further requested that he read aloud the contents of those paragraphs.

So we can consider if it can be withdrawn. “Let him read those paragraphs so that he can sit down,” Ogola said. When they observed his hesitation, the individuals in the courtroom began urging him to read aloud what he intended to withdraw. “The petition contains credible information indicating that Honourable Mrima is a close associate of the proposed Deputy President Kithure Kindiki, and the aforementioned judge either refused or failed to disclose these facts to the parties at the onset,” Ndegwa read aloud from the paragraphs. However, he contended that he aimed to expunge these paragraphs, as he believed they were not accurate. During the same proceeding, veteran lawyer John Khaminwa advised the judges to consider stepping down from the case, suggesting that a new bench be formed if any parties involved expressed dissatisfaction with their management of the proceedings.
